InteractiveAg - Data Use Policy

Effective Date: 1/1/2025

This Data Use Policy explains how InteractiveAg, LLC("InteractiveAg," "we," "us," or "our"), a company based in Indiana, collects, uses, protects, and shares the data you generate and provide through the InteractiveAg mobile application, website, and related services (the "Service").

1. 🌾 Principles of Data Stewardship

InteractiveAg’s data policy is guided by the following principles:

  • Farmer  Owns the Data: You, the farmer, own the raw data generated by your      farming operations and input into the Service.
  • Transparency and Control: We will be clear about what data we collect and how we      use it, and you will have control over sharing and deletion.
  • Security: We commit to implementing reasonable security measures to protect your data.
  • No Commercial Sale of Individual Data: We do not sell your Individual Farm Data to third parties without your explicit, written consent.

2. 💾 Data We Collect

We collect data necessary to provide and improve the Service, which falls into three main categories:

Individual Farm Data (Ag Data): Specific, raw data directly related to your farming operation and tied to your identity. You own this data.

Personal Data: Information that identifies you as an individual farmer or   farm representative (example: Name, email address, phone number, physical address, billing information, account login credentials)

Usage Data: Non-identifiable data about how the Service is accessed and used (Example:

App crash reports, pages viewed, features used, login times, device type)

3. 🎯 How We Use Your Data

InteractiveAg uses your data only for the purposes explicitly stated below:

3.1 Use of Individual Farm Data (Ag Data)

We use your Individual Farm Data for the following purposes directly related to providing you the Service:

  • To generate Farm Analytics, Reports, and Recommendations specific to your grain marketing (e.g., basis, futures, etc).
  • To provide Operational Tools such as financial assessment and management.
  • To facilitate Data Portability and Integration with other authorized third-party services you select.
  • To Troubleshoot, Debug, and Improve the core functionality of the Service.

3.2 Use of Aggregated and Anonymized Data (De-Identified Data)

We may convert your Individual Farm Data into Aggregated and Anonymized Data (data that is stripped of all personally identifiable information and combined with data from many other users so that it cannot be reasonably linked back to you or your specific farm).

We may use this Aggregated and Anonymized Data for:

  • Product Improvement: To improve our algorithms and build new Service features.
  • Research & Benchmarking: To provide general market analysis, benchmark      reports, and industry insights.
  • Commercial Use: To sell or license generalized industry data to third parties      (e.g., researchers, manufacturers, commodity traders). This data will never identify you or your farm individually.

3.3 Use of Personal Data (PII)

We use your Personal Data to:

  • Manage your Account and Billing.
  • Communicate with you regarding service updates, technical support, security      alerts, and changes to our policies.
  • Comply with Legal Obligations (e.g., responding to court orders).

4. 🔗 Sharing and Disclosure of Your Data

We will not sell, rent, or lease your Individual Farm Data or Personal Data to third parties for marketing purposes. Data is only shared under the following conditions:

4.1 With Your Explicit Consent (Data Sharing)

We will share your Individual Farm Data with third parties (e.g., your agronomist, equipment dealer, crop insurer, or other technology platforms) only after you provide explicit, revocable consent through the Service. You control the scope and duration of this access.

4.2 With Our Service Providers (Data Processing)

We use third-party service providers (e.g., cloud hosting, payment processing) to operate the Service. These partners are required to use the data only on our behalf and are prohibited from using your data for any other purpose.

4.3 Legal Requirements

We may disclose your data if required by law or in response to a valid legal process, such as a subpoena, search warrant, or court order. In such cases, and where legally permissible, we will make reasonable efforts to notify you before disclosing your Individual Farm Data.

5. 🔒 Data Security and Retention

5.1 Security Measures

We implement reasonable administrative, technical, and physical security practices appropriate to the volume and nature of the data we process, including data encryption, access control mechanisms, and regular security audits. However, no internet transmission or electronic storage is 100% secure.

5.2 Data Retention and Deletion (Your Right to Delete)

  • Retention: We retain your Individual Farm Data and Personal Data only as long as your account is active or as necessary to provide the Service, resolve disputes, or comply with our legal obligations.
  • Deletion: Upon termination of your account, you have the right to request the      deletion of your Individual Farm Data and Personal Data. We will fulfill this request within a reasonable timeframe, subject to our right to retain Aggregated and Anonymized Data and any data required for legal or auditing purposes.

6. ⚖️ Your Rights and Control (Indiana CDPA)

If the volume of data we process meets the thresholds of the Indiana Consumer Data Protection Act (ICDPA), you may have the following rights, which we will uphold:

  • Right to Access: You can request confirmation of whether we are processing your personal data and access to that data.
  • Right to Correct: You can request the correction of inaccuracies in your      personal data.
